HIPAA Notice

This notice describes how iLIFE Telemed LLC (“iLIFE,” “we,” or “us”) handles information that may be subject to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and related state health privacy laws when you use the website at www.ilife.med, any related mobile application, or any related products and services (collectively, the “Service”).
iLIFE’s HIPAA Status
iLIFE is not a “covered entity” under HIPAA. iLIFE provides technology and administrative services that connect you with independent pharmacies, licensed medical groups and their affiliated physicians, nurse practitioners, and physician assistants, and laboratory services. One or more of those pharmacies, labs, or medical groups may be a “covered entity” or “business associate” under HIPAA, and iLIFE may in some cases serve as a “business associate” of a pharmacy or medical group.
To the extent iLIFE is deemed a business associate, and solely in its role as a business associate, iLIFE may be subject to certain provisions of HIPAA with respect to “protected health information” (“PHI”). Any medical or health information that you provide that is subject to specific protections under applicable state laws (collectively with PHI, “Protected Information”) will be used and disclosed only in accordance with such applicable laws.
Notice of Privacy Practices From Your Provider
The licensed medical groups and providers that treat you through the Service have adopted a separate Notice of Privacy Practices that describes how they use and disclose Protected Information. By accessing or using any part of the Service, you acknowledge receipt of the Notice of Privacy Practices from your medical group and provider(s). A copy of the applicable Notice of Privacy Practices is provided to you during account creation and is available on request.
Customer Information You Provide to iLIFE
When you set up an account with iLIFE, you are creating a direct customer relationship with iLIFE that lets you access the Service. As part of that relationship, you provide information including your name, email address, shipping address, phone number, and certain transactional information. We do not consider that information to be “protected health information” or “medical information” under HIPAA.
In using certain components of the Service, you may also provide health or medical information that is protected under HIPAA or applicable state law. That information is handled in accordance with this notice, your provider’s Notice of Privacy Practices, and our Privacy Policy.
How Protected Information May Be Used and Disclosed
Protected Information you provide through the Service may be used and disclosed for the following purposes, consistent with HIPAA and applicable state law:
- Treatment. To enable your provider(s) to evaluate, diagnose, and treat you, including consultation with other providers involved in your care.
- Payment. To bill and collect payment for products and services you receive through the Service, including processing payments through third-party payment vendors.
- Healthcare operations. For quality assessment, training, credentialing, audits, compliance, and other activities needed to operate the Service.
- Pharmacy and laboratory fulfillment. To enable pharmacies to fill and ship your prescription(s) and labs to perform testing your provider orders.
- Required disclosures. Where required by law, court order, or valid legal process, or where necessary to prevent a serious threat to health or safety.
We do not sell Protected Information, and we will not use or disclose your Protected Information for marketing purposes that require authorization under HIPAA without obtaining your written authorization.
Safeguards
The electronic systems used in the Service include network and software security protocols designed to protect the privacy and security of your information and to safeguard data against intentional or unintentional corruption. Use of the Service may include email and SMS communications that contain Protected Information. iLIFE does not and cannot guarantee the security or privacy of services you use to receive communications, such as your email service provider.
Your Rights
You may have certain rights regarding your Protected Information under HIPAA and applicable state laws. Those rights, which may vary by state, generally include:
- The right to request access to and a copy of your Protected Information held by your provider;
- The right to request correction of inaccurate Protected Information;
- The right to request restrictions on how your Protected Information is used or disclosed;
- The right to request confidential communications at an alternative address or by an alternative method;
- The right to an accounting of certain disclosures;
- The right to a paper copy of your provider’s Notice of Privacy Practices on request;
- The right to file a complaint with iLIFE, your provider, or the U.S. Department of Health and Human Services Office for Civil Rights without retaliation.
To exercise these rights with respect to information held by iLIFE, email privacy@ilife.med. To exercise rights with respect to records held by your provider, contact your provider through the Service. We may need to verify your identity before fulfilling a request.
Consumer Health Data Under State Law
Some state laws regulate “consumer health data” that falls outside HIPAA. For information about how iLIFE collects, uses, and shares consumer health data under those laws, see our Privacy Policy. In the event of a conflict between this HIPAA Notice and a state-specific consumer health data policy, the consumer health data policy applies to the extent it is consistent with applicable state law.
Changes to This Notice
We may update this HIPAA Notice from time to time. Material changes will be reflected by an updated “Last updated” date and posted on this page. Your continued use of the Service after the effective date indicates your acknowledgment of the updated notice.
